1. INTRODUCTION

Below are the legal terms and conditions governing the website www.magneticadesign.it.
All purchases of products made through the site are governed by these general terms and conditions.
The owner of the website www.magneticadesign.it is FORMEST Srl, with registered office in Saonara, PD, Italy, via Emilia Romagna 3/A, VAT no. IT03768010286, REA no. PD-335910, paid-up share capital of €90,000.00.
FORMEST Srl reserves the right to modify the contents of the website (e.g., prices, photos, product features) at any time and without prior notice. Any changes made will be effective from the date they are published.

2. PURCHASES

These General Terms and Conditions of Sale govern the relationship between FORMEST Srl and the Customer regarding the purchase of products through the website www.magneticadesign.it. Any matters not expressly regulated in these Terms and Conditions of Sale shall be governed by the applicable provisions of the Italian Civil Code, Consumer Code (Legislative Decree no. 206/2005), and subsequent regulations.
Customers may purchase products listed in the catalog, described in individual product pages.
To access our sales service, the following requirements are necessary:
– Legal capacity to enter binding contracts
– A valid email address
– A valid device for certification and payment
Pre-order:
For pre-ordered items, availability will be communicated within 72 business hours to the email address provided by the Customer.
Should the Customer wish to cancel the pre-order, they must notify us at: shop@magneticadesign.it, including the order confirmation number.
For return policies, refer to sections 5, 6, and 7 of these Terms and Conditions.
Contract Conclusion:
Once the order is completed, the Customer will receive an order confirmation email within 72 business hours, including the order number and a summary of the purchased products, provided payment is approved.
The Customer may check their order status in their profile’s dedicated section, provided an account has been created.
Receipt of the order confirmation email signifies the conclusion of the Contract.
Product unavailability will be communicated after the purchase request through a notification from Customer Service.

3. PAYMENT METHODS

Purchases on www.magneticadesign.it are managed via PayPal to ensure greater reliability.
Other payment methods (e.g., cash, bank transfers, checks) are not accepted.
All transactions are secured using the latest e-commerce technologies and SSL encryption to protect the Customer’s personal data and credit card information from unauthorized access.
Approved refunds will be issued within 14 business days and credited to the same account used for payment.
Invoices will be issued for each order; providing a tax code or VAT number is mandatory.
The Customer is responsible for entering correct data for the issuance of the electronic invoice in Italy or the fiscal document in the EU.

4. SHIPPING

Shipping is managed by courier services, with delivery times and methods varying by Region/Country.
Products purchased on www.magneticadesign.it are shipped within an estimated 2 to 15 business days (Mon-Fri) after the order is placed, if the payment is successful.
Delivery times depend on courier conditions.
Orders will be processed the first business day following the order, excluding company closure periods.
Shipping Costs:
– Free for orders over €50.00 (excluding any discount codes applied).

The shipping cost for orders below € 50.00 (fifty/00) is € 10.00 (ten/00) to destinations in Italy excluding islands and remote areas.
– For international shipping, costs will be communicated in the order confirmation.
Prices include VAT according to current legislation.
Once the package is shipped, the Customer will receive a confirmation email with a tracking link. If the Customer has an account, he can monitor shipping status in the “Orders” section.
The chosen courier for delivery in Italy will be communicated at time of shipment.

Delivery times may be delayed due to:
– Holidays (e.g., Christmas, public holidays)
– Events beyond control (e.g., natural disasters, strikes, roadblocks, public events, pandemics) events independent of the will of actors involved in the distribution chain, such as natural disasters, road blocks for strikes, demonstrations, traffic accidents, visits to public figures, pandemics, etc.
– Inventory, company closures, or extraordinary circumstances
Couriers do not deliver on public holidays and pre-public holidays or national holidays. Couriers don’t deliver to the plan.

We deliver to:
Italy, Austria, Belgium, Bulgaria, Croatia, Denmark, Finland, France, Germany, Greece, Netherlands, Poland, Portugal, Czech Republic, Romania, Hungary, Slovenia, Slovakia, Spain, Sweden, and Switzerland.

Times are indicative and vary depending on the area of destination.

Traceability: The customer will receive an email with the tracking of the purchased goods when the shipment is sent.
Unclaimed Packages: Two delivery attempts are made; after that, the package is stored at the courier’s facility. The Customer must arrange to collect it. Storage fees will be borne by the Customer.

When sending the order request, please fill in the following fields in detail: name and surname, email, telephone number, destination of goods, tax code and/or VAT number.

The Customer must specify the exact shipping address and consignee/company name, otherwise FORMEST srl will not be held responsible for non-delivery. All additional shipping and/or storage costs shall be charged to the Customer.


In the event of non-collection, except in the event of proven negligence on the part of the courier, FORMEST srl reserves the right not to process further orders if they come from Customers who have refused previous parcels.

FORMEST srl is not responsible for any delay.

5. RIGHT OF WITHDRAWAL AND RETURN FOR DAMAGE DURING TRANSPORT

Customers have the right to withdraw from the Contract without penalty and without providing reasons, following the procedures detailed below.
The withdrawal must be communicated in writing within 14 days to: shop@magneticadesign.it.

The return must be made by the customer, through the shipment of the products subject to withdrawal, by courier. The products must be shipped within 14 (fourteen) business days from the date of delivery: the Customer Service will provide the destination address for the return.

For the purposes of the valid exercise of the above right of withdrawal, the Customer must comply with the following conditions and procedures:  the withdrawal may also apply to individual products forming the subject of a single purchase order, provided that withdrawal applies to the product in its entirety, so the customer will not be able to exercise the withdrawal limited to a part of the single product purchased; the customer has the obligation to return the goods in its original condition and packaging. If the returned product has lost value, for example due to its use, FORMEST srl will retain the sum equal to the value that the product has lost.

In addition, the right of withdrawal does not apply to custom-made or personalized goods.

From the return, FORMEST srl has 14 (fourteen) business days to make the refund to the Customer. FORMEST srl will reimburse the value of the purchased goods and any shipping costs (understood as expenses incurred for delivery of the goods to the Customer). Direct costs of returning the goods to Formest will be excluded from reimbursement, which will remain at the expense of the Customer.

If the returned product is damaged during transport, FORMEST srl will only be required to inform the Customer of the incident in order to allow him to promptly file for complaint against the courier and/ or the insurance company. FORMEST srl is not liable in any way for damage or theft or loss of products returned; therefore, all related risk remains the sole responsibility of the Customer.

In any case of non-compliance with the conditions and procedures for exercising the withdrawal provided above, as well as in the event of damage to products due to causes other than the transport of the same, the Sales Contract shall remain valid and effective. FORMEST srl will return the products to the Customer, charging the latter for the corresponding shipping costs.

6. CONDITIONS FOR RETURNS IN CASE OF PURCHASE WITHDRAWAL

1. The Customer must contact Customer Service to initiate the return process.
2. Within a maximum of 72 business hours, the Customer will receive instructions for the return process. This time frame may vary due to:
– Holidays (for example Christmas, Ferragosto, and public holidays)
– Events beyond the control of the supply chain participants (for example natural disasters, strikes, roadblocks, public events, pandemics)
– Inventory, company closures, or extraordinary circumstances
3. Products must be returned in their original packaging, complete with all elements and any attached manuals. Returned items must be unused and in fully functioning condition.
4. Upon receipt of the return, the products will be inspected to ensure they are intact and complete.
5. Customers should retain the proof of shipping until confirmation of receipt and refund is provided.
6. Refunds will be processed using the same payment method used for the purchase or in a different manner agreed upon by the parties.

Customized items are excluded from returns.

7. RETURNS FOR DAMAGED, DEFECTIVE, OR INCORRECT ITEMS

If the Customer receives a damaged, defective, non-conforming, or incorrect product, or an incomplete order, they may request a replacement by contacting Customer Service, specifying “Damaged, non-conforming, or incorrect item” as the reason, and attaching clear images and/or videos showing the defect.

The legal warranty for non-conformity defects lasts two years from product delivery. The Customer must report the defect within two months of discovering it.

Normal wear and tear due to use or any other case attributable to poor or incorrect handling of the product by the Customer is excluded from the warranty.

If the product is found to be non-conforming, we will replace and/or refund the price. FORMEST srl will make every effort to replace, at its own expense and care, with other products of the same quality available in its warehouses, those delivered products that were damaged or defective, provided that the same have been returned by the Customer in the original package complete of all the parts that compose it. If the replacement with the same product is not possible (for example, due to out of the catalog/ revision of the product), the Customer will be reimbursed the amount paid for the product found defective.

The refund is usually made within 14 working days. If the customer has not received a refund after this time, please write to Customer Services as a matter of urgency.

We remind the customer that if he/she has opened a chargeback or dispute on PayPal or other payment systems, we will not be able to fulfil his/her request for a refund or replacement.

8. COMMUNICATIONS AND COMPLAINTS

All communications or complaints from the Customer regarding Sales Contracts must be sent via email to: shop@magneticadesign.it.

9. PERSONAL DATA PROCESSING AND PRIVACY

For information on the processing of personal data by FORMEST Srl, refer to the dedicated Privacy Policy section.

10. JURISDICTION/APPLICABLE LAW

Users visiting the pages of www.magneticadesign.it agree to submit to the jurisdiction of Italian law.
For any legal disputes, as per current regulations, the competent court is that of the Customer’s residence. For all other users, jurisdiction is held by the Court of Padua, Italy.
